Notice to customers of Eldens Finance Limited

Following the appointment of William Antony Batty and Hugh Jesseman as Joint Administrators to Eldens Finance Limited, we are currently assessing the Company’s affairs.  We are working to ensure that customer records, data and pledged items are secure and protected and that customer enquiries are addressed and continue to be handled appropriately. Customers will be provided with updates as the administration progresses and further information becomes available.

What is Administration?

Administration is an insolvency process under the Insolvency Act 1986. Day to day oversight of the Company now sits with the Joint Administrators whose role includes realising the Company’s assets and dealing with creditors of the Company. If there are sufficient realisations the  Administrators will pay a dividend to creditors in accordance with the statutory order of priority.

Who are Antony Batty & Company LTD (ABc)?

ABc are a Firm of Licensed Insolvency Practitioners, WA Batty and HF Jesseman of that Firm are the Joint Administrators and are regulated by the Institute of Chartered Accountants of England & Wales. For more information visit our website.

How do I contact the Joint Administrators?

Who appointed ABc?

Beech Hill Capital Ltd, who provided finance to Eldens under the terms of a Fixed and Floating Charge Debenture, appointed the Joint administrators under the powers contained in their Qualifying Floating Charge.

Is the Company still trading?

No.

What happens next?

We are currently assessing the Company’s affairs. Under insolvency legislation, we are required to prepare proposals for creditors setting out how they intend to conduct the Administration. These proposals are expected to be issued within eight weeks of our appointment.

What steps are being taken to protect customers?

We are working to ensure that customer records, data and pledged items are safeguarded and that customer enquiries continue to be handled appropriately. Customers will be provided with updates as further information becomes available.

Where is the property I pledged?

Based on the Company’s records, we understand that all pledged property is securely held by third party specialist storage companies. The Joint Administrators, or their agents will be inspecting and taking control of all pledged property and other assets of the company and will provide further updates in due course.

If I believe I still have title to the pledged property, what should I do?

Please write to us* and enclose all relevant documentation. The Joint Administrators will investigate your claim and take legal advice if necessary. We will endeavour to inform you of our decision within a reasonable timeframe. Nothing in this letter or any response to your claim shall constitute a waiver of any of the Joint Administrators’ rights or powers under the Insolvency Act 1986 or otherwise.

If I consider I am owed money by Eldens

Please contact our office to complete a claim form in the first instance. The claim form should be returned to us along with as much information and supporting documentation as soon as possible. We will review claims and provide any information on the relevant process and whether any further information is required from you.

Will my finance agreement be affected?

We are reviewing the Company’s position and will provide further information if there are any changes that affect customers. In the meantime, customers should continue to comply with the terms of their agreements.

If you are currently making payments to the Company in accordance with a loan agreement, then please contact our office as soon as possible. It is important that you continue to make any contractual payments that fall due but these should now be paid to the Administration estate bank account operated by the Joint Administrators.

Who will investigate the conduct of the Directors?

The Joint Administrators are required to carry out certain investigations and to submit information to theInsolvency Service, a Government Department who will decide if there are any grounds for action to be brought

How do I make a complaint?

You should address any complaints about your dealings with Eldens to the Joint Administrators in the first instance.
